Formal Notice to Cancel Agreement and Cease Contact

Dear Sir/Madam,

I am writing in relation to the above references to formally cancel my agreement with [Enforcement agency] with immediate effect.

This agreement was made under duress, as I was subjected to persistent and distressing contact from your organisation, including [*Amend as appropriate the list below]

I have been advised that this matter should be addressed directly with [your council authority]. Your continuous and excessive contact has caused significant distress and has had a detrimental impact on my [recovery and ] mental health.

I am classed as a vulnerable adult, as defined within the Financial Conduct Authority (FCA) Consumer Credit Sourcebook (CONC 7.2.1 and 7.2.8) and the Credit Services Association (CSA) Code of Practice. Both regulatory frameworks clearly require that debt collection firms treat vulnerable customers with fairness, forbearance, and sensitivity to their personal circumstances.

Your actions have not reflected these standards and have instead amounted to harassment and undue pressure to agree to a repayment plan that I did not enter into freely. As such, I will not be honouring the payment arrangement, which was agreed under duress.

Accordingly, I require that Marston Recovery:

  1. Cease all forms of contact with me immediately, including by telephone, text, letter, email, or in person.
  2. Cease all enforcement or collection activity in relation to this matter.
  3. Confirm in writing that my account has been marked as vulnerable and that all contact and enforcement activity have ceased.

Any further contact from Marston Recovery or its representatives will be treated as harassment and reported as a breach of:

  • The FCA Consumer Credit Sourcebook (CONC 7)
  • The CSA Code of Practice
  • The Equality Act 2010
  • Health and Disability legislation
  • And relevant case law, including Wayne Leighton v Bristow & Sutor [2020]

I have received support and guidance in preparing this letter to ensure this situation is managed appropriately. I expect acknowledgment of this correspondence and written confirmation that you have ceased all contact and enforcement actions.
