Subject: NOTICE BEFORE ACTION – Unlawful Deductions from Universal Credit
Dear Sir/Madam,
Re: Unlawful Deductions from Universal Credit – Demand for Refund and Cease and Desist
I am writing to you in connection with the deductions you have instructed the Department for Work and Pensions (DWP) to make from my Universal Credit, allegedly in respect of a council tax liability order said to have been issued by the Magistrates’ Court.
I do not accept liability for the sums you have claimed and have not been provided with any evidence of a valid and enforceable liability order in my name.
Accordingly, I now formally demand the following within 30 days of the date of this notice:
- The immediate return of all monies unlawfully deducted from my Universal Credit to date;
- Documentary evidence of the alleged liability order, including an office copy of the sealed order from the Magistrates’ Court, verifying the existence and lawfulness of the liability order you claim to rely upon; and
- A written confirmation that you will cease and desist from taking any further enforcement or deductions unless and until you provide evidence of a valid, enforceable liability order.
Should you fail to comply with the above within 30 calendar days, I will have no alternative but to commence legal proceedings in the County Court without further notice to you. These proceedings will seek:
Recovery of all monies unlawfully taken;
Interest pursuant to section 69 of the County Courts Act 1984; and
Costs and any other relief the court deems just.
This letter is sent to you in good faith and in compliance with the Pre-Action Protocol for Debt Claims under the Civil Procedure Rules.
I expect a full written response within the specified 30-day period. Failure to engage or provide satisfactory evidence will be relied upon in any subsequent legal action.
