Challenging a Property Charging Order

Someone has questioned the validity of a charging order placed on their property by the local council for alleged non-payment of Council Tax. Concerned about the legal standing of the order, the individual is seeking advice on whether to request a full Data Subject Access Request (DSAR) from the Land Registry or focus specifically on documents related to the charge.

It was suggested that the resident submit a full DSAR and also request a copy of the court order that allegedly authorises the charging order. It has been suggested that in many cases, such court orders may not exist and, if not produced, the resident could issue a “Notice Before Action” — a formal step before pursuing legal action.
