Subject: Cease and Desist – Unsubstantiated Council Tax Demand
Dear Sir/Madam,
I am writing in relation to your recent demand for council tax, which you allege is supported by a liability order said to have been issued by a Magistrates’ Court.
Please take notice that unless such an order has been duly made by a competent court, registered on the Register of Judgments, Orders and Fines, and an official office copy of the liability order can be produced, your claim is without lawful substance and amounts to nothing more than hearsay.
Having checked the Register of Judgments, I can confirm that no such liability order is recorded in my name. Therefore, unless you are able to provide me with a certified office copy of the alleged order, the basis of your enforcement claim is unfounded.
Accordingly, I now require you to:
Cease and desist from making further demands for payment, threatening enforcement, or adding costs/penalties which rely upon the existence of this alleged liability order.
Confirm in writing whether a liability order exists, and if so, provide a certified office copy issued by the court as proof.
Suspend all collection and enforcement activities until such proof is furnished.
Should you fail to comply with this request, or continue to pursue enforcement without lawful basis, I reserve my rights to challenge your conduct as unlawful, vexatious, and an abuse of process.
I look forward to your response within 14 days of the date of this letter.
Yours faithfully,
