CCJ for private parking fine
I have received a ccj for not paying a private parking fine, is there anyway of getting this removed without taking the n24 route?
It has been suggested that you search https://www.trustonline.org.uk/ to see if the CCJ is legitimately registered on the Register of Judgements, Orders and fines.
If it is, you’ll need to submit an N244 form to have it set-aside on the grounds that you weren’t the driver who was responsible for breaching the tacit consent contract.
If it isn’t registered, it can be ignored and cannot be enforced.
The onus is on them to prove you were the driver.
You’re under no legal obligation to provide the driver’s details unless it’s for an offence under the Road Traffic Act [1988], whereby Section 172 compels the registered keeper to provide driver details within 28 days of the Notice of Intended Prosecution (NIP).
Parking isn’t a road traffic offence, so Section 172 Road Traffic Act [1988] doesn’t apply.
