AP1 and Land Registry Scenario
We submitted an AP1 form in October of last year. Initially Land Registry wrote to say they had cancelled our application and we wrote back refuting this and that is where the Higher Executive Officer became involved. We wrote to the H.E.O on 27th March demanding to know why they wouldn’t honour our request, this was ignored so we wrote back on 14th April (always signed for) to say it may have been overlooked or ignored but this matter certainly needs addressing because it is of the upmost importance to us, we now believe it has been ignored as we have still had no response.
Suggested approach…
It’s likely that they’ve been advised to put people off changing the “local authority” section, in the hope that people are too apathetic to follow it up. Perhaps submit an FOI asking them to provide a legal basis for their refusal. They may change their mind if they’re forced to explain their reasoning and legal basis for the decision. Their hope is that most people will take “no” for an answer. It’s not the job of the Land Registry to determine who is or isn’t the local authority on a title deed. It’s their job to record details provided to them and to update records upon request.
